Form 130 and B1/B2

  • Form 130 and B1/B2

    Hi,

    I am US Citizen and My parents are perminent residents(They are 90 Yrs old). Want to file 130 for my sister aged above 21 and unmarried. My sister has B1/B2 visa and travel between US and India for every 1 year(Comes here to see parents for 5 months and take care of them).

    We (parents and me) want to file 130 form to my sister. I have three questions.

    1. Do I need to start 130 when she is in India or US?
    2. If she is here, Do I mention her I94 information in form 130?
    3. Is she going to have any problem at port of entry in her next visit if 130 is in process?

      Thanks for your suggestions. Your answer for 3rd question May Be is making me worried now.

      I Have two old parents with me, she has to come to US to be with them and go back. She dont need to go back for any reason, she is going back only becasue she is not able to stay more than 6 months on B1/B2.

      Permenant solution for this is to apply for I130. If I apply it, I may lose the option of my sister visiting US and my sister may not be able to see parents again. Meaning, she may be stuck in India until her 130 gets approved, which is 10+ years. H1 and Marriage is becoming a Mirage to me. Tried that before.

      I guess I Dont have a solution for this. If you have any solution for this, please let me know.
