    Hi,
    I filed for reentry permit on Sep 2002 and left USA. Now I need to go back to US. Renetry permit is not approved yet, it says it takes from 450 to 480 days.
    What should I do? Can I go to US with the I130 receipt only?

      No, you can't come back with just the receipt notice. You can only return with a valid reentry permit, which you don't have at this point. You also have to keep in mind that issuance of a reentry permit is completely in the discretion of the CIS examiner. You certainly ran a risk with staying abroad without the reentry permit in hand.
      This trap is common with the long processing times for the reentry permit.
      It doesn't help you, but for the benefit of others I recommend to come back before 1 year is over if the reentry permit is not approved yet.

        when do they reject?

        Getting scared after reading your post. Are there precedence of rejecting reentry permit application? In which circumstances do they reject?

          It is not clear how many reentry permits are rejected, since there are no statistics on it.
          But they do reject reentry permits, and there are people who appeal that. The Board of Appeals decisions are on the USCIS website, and while browsing through there, I have come across appeals to overturn reentry denial decisions.
          As for the reasons, besides the obvious ones, like when the applicant wasn't in the US when filing the application, the examiner can deny it when he thinks that the reasons are not sufficient, or when the person has been out of the US for a long time already.It is in their discretion.

            We applied for re-entry in Aug 2002. And we got the approval notice in Dec, 2004. We were in India after applying the re-entry.

              Could you please help me with following questions:

              I am in Dilemma about where to send approved ReEntry Permit [ REP ].

              I need to go to India for family reasons [ social issues ].
              I do not know how long I will be there. It can be more than one year.

              I have following questions:

              1. What are the resaons that are acceptable for REP ?
              Is "To take care of parents mental health" a valid reaon ?
              2. Where shuold I request to send the REP.
              To US Consulate in India OR to a friends address in US ? In later case, do I need to do address change with INS ?

              3. Could it be a problem if I terminate my apartment lease ?

              4. What if I have to return after one year but before I receive REP approval ? What if REP is received after two years ? Is there any workaround ?

              5. If I give a friends address in US to send REP,
              could it be mailed out to me in India ?

              6. What is the date before which I should not leave US ?
              A. REP application postmark date ?
              B. REP applicationre ceipt date by NSC ?
              c. Automated message that REP application is accepted ?

              I apologize for so many questions.
              I will appreciate any help.
