  • Hello JoeF, need help on N 470

    1. Does N 470 preserve "physical residency" status for naturalization requirements, if I am employed by a US corporation and work location is outside USA? The form mentions only US govt. & clergy for this special waiver.

    2. In the above scenario, given a choice of N 470 or Rentry Permit, is one better than the other?

    Thanks in advance.

    Re: N-470

The form also talks about "whether the employing organization is an American firm or corporation engaged in the development of foreign trade and commerce of the United States, or subsidiary thereof"
And that also is the formulation used in the law INA 316(b).
The N-470 does preserve the continuous residency in these cases. The physical presence requirement is not affected by an N-470, except if the person is employed by the US government (INA316) or a clery person (INA317.)

A reentry permit does not do anything with respect to naturalization. It governs the validity of your GC. Regardless if you filed an N-470, you still need a reentry permit if you stay abroad for over 1 year. The instructions also state that: "Approval of this application will not relieve you of the requirement to present a valid document for reentry into the United
    States."
