  • Abandonment of Green Card

    Dear Sir/Madame:

I would very much appreciate if you can provide me with some guidance on my situation. I am a permanent resident of the U.S. and have been since the age of 11. However, due to circumstances beyond my control my mother fell ill in Dubai and was in a coma and bedridden since 1999. During that time I left the U.S. at the age of 19 to take care of her during her condition. She passed away in her coma in 2007 and since then applying for a visa into the U.S. as a non immigrant has been very difficult.

Unfortunately and oversight on my part, I overextended my stay in Dubai and was unable to renew my Green Card in time upon travel back in 2005. At immigration, I was stopped naturally and was asked to appear in court to which I made the decision to leave before the assigned court date. My mother's condition was very critical at the time and I really had no choice. Upon speaking with my lawyer I had asked him to appear on my behalf with a signed statement accepting my abandonment of Green Card, with the promise that I would have the chance to re-enter the country without any issues.

I have clearly read your website and understand that there are exceptions for eligibility for visa waiver. I know taking care of sick relatives may not fall under this category but I am not a criminal. I have behaved irresponsibly in the situation but I have done it for the sake of my blood relative. I am not asking to retain the residence status or even re-obtain it and it is a declaration I am willing to sign to at least grant me re-entry.

Please note that I have family in the U.S. to which I have not seen in years and with my mother's passing, it has not been easy. I am willing to provide you with any details to prove this situation that may help you and I am willing to adhere to any rules that are set. You may check my record thoroughly and see that I have caused no harm to anyone or anything. All I request is a fair try.

Thank you for your understanding and response.

    Regards,
    Boocha Pawa/Miss
