  • RE-ENTRY PERMIT

    SINCE 1.5 YEARS WE HAVE GREEN CARD.
    NOW WE HAVE MOVED PERMENANTLY TO INDIA AS I GOT JOB TRANSFER FROM MY COMPANY.
    BUT I WANT TO MAINTAIN MY GC.
    BEFORE COMING TO INDIA WE FILED FOR RE-ENTRY PERMIT.
    MY CO TOLD ME THAT THIS WILL BE VALID FOR 2 YEARS.
    I HAVE NOT RECEIVED RE-ENTRY PERMIT YET.
    I HAVE GIVEN REASON AS "COMPANY TRANSFER " IS THAT OK
    IF I GET RE-ENTRY PERMIT IN HAND CAN I GO AFTER 2 YEARS I MEAN TO SAY UPTO VALIDATION OF RE-ENTRY PERMIT
    I WILL APPREICATE IF SOMEBODY CAN PUT FOCUS ON THIS
    IF WE WANT TO MAINTAIN JUST GC CAN WE STAY FOR 2 WEEKS & COME BACK TO INDIA ?

    First, please do not write in All-Caps. This is considered shouting, and is really hard to read.
    Second, if you moved out of the US permanently you already have lost the GC.
    For the GC to remain valid, you have to reside in the US. You can temporarily stay abroad, of course, but not permanently.
    You can not just come back to the US once in a while , re-entry permit or not.

      See as i told i have applied for re entry permit.
      I have not said i will never go to us. I want to stay 2 year in india
      I want to maintain my GC.
      Once i receive my re-entry permit can i go after two year
      or upto when re-entry permit is valid.
      Thats what i asked .
      You said you already lost the GC i did not understand this
      i will appreciate if you can help me

        Well, read the links I provided.
        As a Permanent Resident, you have to permanently reside in the US. It is called "Permanent Residence" for a reason.
        If you move out of the US, even for one day, you have abandoned the GC.
        To keep the GC, the most important thing is that your stay abroad has to be temporary. You said "company transfer", and didn't say anything about it being of a temporary nature with a clear ending date. More importantly, you said that you "moved permanently". Quite the opposite from a temporary stay abroad.
        You can not just show up just once in a while in the US.
        You also have to file US Resident tax returns and declare your worldwide income.

        For the reentry permit, issuance of a reentry permit is discretionary. If the BCIS examiner thinks that your reasons are not of a temporary nature, they can easily deny the application.
        If you get a re-entry permit, it is valid for 2 years from the issuance. You can stay abroad during the validity of the re-entry permit. But your stay abroad still has to be temporary in nature, and you have to have the intent to come back to the US at all times, and you have to file US tax returns...

          Re-entry permit

          Hi I just wanted to know what happened to your re-entry situation. My parents went to India in May 2007, and have to come back before may 2009. But the re-entry permit is valid until Dec 2009. Can they stay in India until December.
