US Citizen (born in India) is sick in India and can't return to the US

  • US Citizen (born in India) is sick in India and can't return to the US

    person's background:

    - born in india
    - became US citizen 30 years ago
    - also is has OCI (overseas citizen of india)
    - age is 75 years
    - has children living in the US (also US citizens)

    person went to india to visit family. found out they needed hip surgery but also was diagnosed with mental issues including dimentia. person's relative in india will take care of them as they need round the clock care that they can't afford in the US. person is also unable to make coherent decisions on their own. children have full power of attorney in the US.

    should the US consulate be informed of the current status of the citizen and that they can not return to the US due to health reasons?
    if the person passes away, will there be trouble using the foreign death certificate to complete estate related affairs in the US after the person passes away?
    are there any steps needed to be taken via the US consulate to certify the foreign death certificate?

    You do not need to contact anyone about the person's current status.
    A death certificate is a death certificate. The country in which it is issued does not matter. Once the certificate is issued, it may have to be certified by a court in the country in which the certificate is issued to state it is a true document but nothing more than that.

      If dad passes away in India, report the death to the U.S. Consulate having jurisdiction over location of death. The State Department will issue a second death certificate (sometimes) as an official State Department report. I'm not sure if Consulates still issue that document, but they had been until a couple of years ago.
