    Hello,

    Please advise I am in jeopardy.

    My employer will be filing GC Labor certification in few weeks but I will be in 6th year by that time. So my employer suggesting me to take a vacation for 30 days either go to India or Canada as I hold Canada Visiting visa valid till Nov 18, 2013, so that we can have a buffer for 30 days and we can use it for getting extension even we get audit/query on GC Labor certification (possibly to use as filing labor before 6th year starts, I think). I am flexible to take vacation at present.

    Problem: I recently caught under DUI 1st offense in PA, my case is still under process waiting for final hearing (next, I will enroll to ARD program), In my research as far as I know going for stamping in India on DUI pending case is very risk and I have to go as I do not have valid US stamping.

    Question: As I hold Canada Visiting visa valid till Nov 18, 2013. I am thinking to stay in Canada for 30 days (I have family friends in Canada) and come back to USA ?? Can I do that, I am not sure how this works, so please advise. Also, can I tell them at port of entry in Canada that I am gonna stay for a month on vacation ??

    Someone please advise as soon as you can because I will be in 6th year by Nov 9, 2012. So I have to take a decision very soon.
