I'm going to try to make a long story short, as it is very relevent to this problem.
In 1969 my husband was born in NYC to Canadian parents. Seems simple enough, except his parents were fugitives from the law and entered the US under assumed names AND had him under a assumed name.
His US birth certificate his name is *male Smith*
They crossed back into Canada when he was six weeks old, but as far as we know, he wasn't registered. (His mom is deceased and his dad we don't associate with for obvious reasons)
He's gone by his *real* name all of his life and did a legal name change in 1988. All of his id is in his *real* name except for his US birth certificate and his draft letter.
He's lived in Canada all of his life, worked here, paid taxes, and has married two Canadian women and has a child.
Now with all of the changes happening we wanted to get him a passport and get this all straightend out. For the last year we've tried to find out if he's classified as a Canadian citizen but no one would give us a straight answer. We've finally applyed for a record search and are awaiting the results.
Meanwhile we wanted to travel this fall, so on Friday he went to the American Embassy and tried to get a American passport. (Born in the US = American...or so we thought)
He brought all of his id, all the info and was basically told SOL! They wont' do anything to help him and as far as they're concerned, being born IN the US doesn't MAKE him a US citizen.
So now he sits, not knowing if he's a darn American, Canadian, Duel or WTF? Any ideas or suggestions besides just wait for the search? We've been told that can take up to three months and we have a trip booked for October.
