My employer is applying for my Canada ICT Visa and my wife will get an open work permit. In this case, need the following info:-
1. There is a new rule by IRCC that if someone comes as dependent spouse, then they cannot become primary in any other visa/work permit application (i.e. the ICT candidate cannot claim an open work permit on the basis of spouse's open work permit). Does this apply even for Express Entry PR application? Can my wife apply for Express Entry as the primary applicant even if she is in Canada as a dependent?
2. If my wife gets a job offer with her current employer based on her open work permit, can she get 50 points in CRS for valid job offer under FSW? (She is currently working in India and will request her employer, an IT company, to give her a role in Canada based on her open work permit). Are there any conditions to be met in the job offer by her current employer for her to claim the 50 CRS points?
