Mumbai/Delhi/Chennai. H1 Stamping after Arrest.

    Hello sir,

    Today got the mail from Mumbai Consulate to collect the green 221g form which will depict the medical tests to be performed. They asked me to collect the letter from Mumbai or else send some one with the authority letter.
    Since Im not in Mumbai Im sending my brother to collect the letter from the counter.

    Do you know how much time will it take for the tests to be conducted and the results to be passed to the US Consulate?
    I wanted to ask you if there is any particular hospital which will process the medical tests faster and send the results to the US consulate.I heard the hospitals in chennai are a bit slow in this. Also the doctors can screw you up.Is that true? Please let me know any information you have....

    Also We contacted the lawyer and he said he can take up the case and do the following:-
    Contact police and obtain a certified copy of report, then if the case has been filed, contact court, get a certified copy of complaint, determine if you will be able to get into ARD, assuming you can, (usually you have to be here), since you are not it MAY be possible to get something from District Attorney’s office saying that you are eligible, along with other documents, this MAY be sufficient for consulate abroad to understand the situation.

    Please let me know your thoughts on this.
    I appreciate your help in this regard.

      Just an update from me..
      Did the medical test and dropped the passport at the consulate.
      Waiting for further instructions from the consulate.
      Lawyer could manage to get me
      1)A copy of criminal complaint from the police station which has been filed in the court
      2)A letter which my attorney sent to the court requesting to send the court date to the attorney since Im out of country
      3)A letter from my attorney stating that I would be most probably entering the ARD Program as part of the DUI charges against me.

      He said thats all he can manage at this point of time.
      So if the consulate calls me then I can show these documents to the visa officer.But not sure if it would help.

        What if the arrest/conviction was 3 years ago

Can I go to Bombay or Delhi? I am from Karnataka and we usually go to Chennai. (Though, I've never been to Chennai since I got my F1 thru drop-box from chennai and got first H1 stamping in calgary.

            hi.. from what I've read on forums.. an arrest of 3 years old should not popup on the system. so u are fine.. but u still need to tell the truth and carry the arrest/ticket/conviction documents..

            dont go to Canada.. you cant go.. since reckless driving is a jail-term conviction in Canada.. they'd say.. you should be in jail not on canadian streets.. if u are going to india. simply skip chennai.. since they are doing all kinda crazy things for alcohol related cases.. go to mumbai or delhi..

            me? i figured.. 8 yrs i visited india.. whats the biggie... another year i'd hv crossed the 3 yrs after arrest.. so holding guns until then.. hk2009.. let me know how it goes and wht happens to ya.. coz looks like we are in the same exact boat in difft time zones.. goodluck

              Hi everyone,

              I got my visa stamped after the medical test..Actually when the US Consulate got the medical test results they didnt even call me for another personal interview. They jus stamped my visa and sent it to me by courier...
              so by gods grace everythings fine now..im back in office working....
              the case has started and I would be in the ARD programme if everything goes fine.
              I heard ARD programme is neither a conviction nor plead guilty..so will it be an issue for me to travel to canada(I have a visa valid till 2011)
              Also I would need to go to UK this year(again visa is valid till November 2009) and will need to apply for another visa to France for my work purposes...
              Will the ARD programme or my DUI arrest block these ?

                So when you entered Canada did they ask you whether you were arrested for alcohol related stuff?
                thats interesting cause I thought if you have the canada visa you can enter with out any issues.
                Also after one year of probation you can apply for expungement of records rt?

                  I recently got my H1 stamping in Mumbai. I had a reckless driving for speeding. The officer only asked me if i had any arrests on my record. I said no only speeding tickets. He said OK and give me the visa.

                    if the arrest/conviction was 3 years ago, is it all going to be fine, just like it is stated above?
                    did anyone after 3 years of arrest/conviction have any trouble?

                      DUI charges

                      Hello all,

                      I was arrested for DUI on March 9 2013. I pleaded not guilty and 1.5 months later along with my H1B approval I got a letter also requesting me to come to home base (bombay) for stamping. This is my second stamping which I was planning to schedule for Dec 2013. It got preponed due to this letter. I am not sure if this is only clerical -also this has happened post the Boston attack which included US educated students. I am not sure what should be my best approach - either / or I have to leave.

                      My client will keep me employed. My employer will keep me employed. For how long who knows.
