Hi All,
I was charged with the below:
a) Solicitation Of sexual Act
b) Refusal To Arrest
c) Loitering
Out of these charges, Refusal to arrest and Loitering has been nolle prosecuted.
Solicitation of sexual act was put on a 11 Months Diversion which would end in June 2011.
I am planning to go to India in July 2011. I am under H1B extension and hence I need to get my Visa stamped in India before coming back to US.
I understand that we will have to declare the facts about the charges/arrests in the DS-160 form and support it with the court documents during the interview.
Here are my concerns:
1. Will my visa be rejected based on the above mentioned charges even after furnishing the supporting documents?
2. Let’s say if the Visa is approved and I am travelling back to US, will i face any problems at the POE (Port Of Entry)?
Please let me know if you have come across a similar situation. Your help will be much appreciated.
