DWI class B...

Hi Guys,

I was arrested for DWI Bac 0.15 and was fingerprinted and photographed.
My case is still pending at the court.
I will be going for trial which would be in April 2012 and for all other court dates which occurs monthly my lawyer is attending that.
I am thinking to go to India for vacation in December 2011 to January 2012.
I have H1 stamped till 2013 so not going for stamping.

Will i have any problem which coming back to US since my case is pending?
What about POE?

Please do let me know your thoughts and experience.
It will help me a lot to take my decision to go or not.
