  • H4 to L2 conversion: Will the EAD process any different?

    Hi,

    I am on H1B and my spouse on H4. I am moving forward to convert my H1b to L1 so that my spouse can also work. People told me conversion can be achieved in 1-2 months. I want to know, once the conversion is done (H4 -- L2):

    1- Can my wife apply for EAD immediately?
    2- Will there be any diff. in the process since this is a transfer case?
    3- How much time will it take to get EAD approval and for my wife to join a office?

    Please Help....

    Really annoying as H4 people cannot work....

    If you qualify for L1B you can file an H1 to L1 COS, one of condition for L1 is that you must have worked in a specialized knowledge or managerial/executive capacity abroad for at least 1 year within the three years prior to admission to the U.S.

    Along with your H1 to L1 COS you should apply H4 to L2 COS too for your wife, you can apply EAD at the same time of applying H4 to L2 COS. It can take 2-3 Months for EAD to come in .

    On L1 you cant change employer, your wife on L2 and EAD can change employer.

    This is my opinion not legal advice.

      I am currently working for a US Company and was working earlier for the same Company's outside US office for many years.

        You should have been working, outside US, for at least 1 Year in the last 3 Years for the employer who is filing L1 petition for you.

          Great...Thn I think I should be fine.

          One last thing, does the EAD process takes 3 months to process? or 3 Months is the max. that it can take? Basically the timeline and if there is anything that can help expedite the process.
