My husband applied for EB1 category for which I-140 got approved two weeks back. We are ready to send I-485, I-765 and I-131 (advanced parole). However, an emergency has arose in my house and I need to travel to India in a week for 2-3 weeks. We are confused about how should I travel to India.
We see following two options:
1. We send the I-485/I-765/I-131 for both of us now and once I get the receipt from USCIS I apply for emergency parole and go on that. Another associated question would be then whether my original I-131 (advanced parole) would still remain valid and I can use that after I come back on emergency advanced parole (I need to go back to India in summer again for another reason).
2. I travel to India and get my H1B re-stamped (it expired last year), come back to US and then send my I-485/I-765/I-131. An associated question would be if we choose this option whether we should go ahead and send my husbands and apply for mine later.
Which of these options would be best to choose given our situation.
A quick response from those who have been in similar situation or a lawyer would be highly appreciated.
