Staying in USA with EAD- unemployed?
Hi Friends,
I am in academic H1B (non cap) and recently I have filed I-140/I-485 petition concurrently and expecting to receive EAD/AP in a month or two. Unfortunately, I will be laid off on Nov 30th and I have find a new employer in mean time.
1) If I receive the EAD whether it is legal to stay in USA unemployed for some time or I need to go out of the country?
2) If I use EAD for a new employer is it possible to file new H1B petition for the same job? The reason for that question is because my I-140 petition is still pending.
Please advise me on this issue.
