  • Length of Stay/Leaving without Advanced Parole

    Hello everyone.

My wife and I married back in November and I plan on going to China in June to meet her parents. I'm working full time currently and I'm unable to stay longer than a week and a half. She however wants to stay in China and get an internship so she can find work in the US easier.

On the Advance Parole Document it asks for expected length of stay abroad. My wife would like to stay longer than 100 days.

Is this risky? We already bought the tickets.

Similarly, if she were to leave without the document and it was emailed to us, could I just email the document to her? Thus allowing her to return to the US?

    Thank you very much

If you are applying for an Advance Parole as part of the Adjustment of Status, it is essential that your wife does not miss her Biometrics or Adjustment of Status interview.

You can't "email" the Advance Parole to wife. It is now a plastic card, part of the Work Authorization card, referred to as a "combo card." Until about 3 years ago, Advance Parole was on a document, with her original photograph, but that has changed.

      Ray,

Thank you very much for your input. We have decided that it would be best that she comes back sooner than the proposed 100+ days that I had originally said.

Previously I had said "email" however I meant mail to her using a courier service. Do you think mailing to her would be okay?

We plan on sending everything out to USCIS tomorrow. Hoping for everything to go quietly and smoothly.

      Thanks for your help.

      John

If you have completed the Adjustment package with both I-765 and I-131 applications included, you will get a single "Combo" card with both "Employment Authorization" and "Advance Parole" printed on the card. Don't risk losing that by sending through postal mail.
