I'm a citizen, wife is under dreamers deferred action, what's next?

  • I'm a citizen, wife is under dreamers deferred action, what's next?

    I know we have to submit a petition, can someone direct me to the right form to fill please? Or what I have to do to submit a petition for her? Correct me if I'm wrong but to my understanding this is the process I must do:

    Submit a petition
    Obtain an advance parole travel visa
    Have her enter the U.S. legally
    Obtain green card..

    Can you tell me if I'm right? And if so I need help to know how to submit a petition. Short on money can't pay a lawyer for this. Really need your help...Thank you

    What was your wife's basis for the Deferred Action procedure? Had she been brought to the States as a child with no record of entry? Or did she originally enter the U.S. with a visa?

      She was brought when she was 5yrs old and has lived here ever since

        Your wife's deferred action status probably does not provide for eventual Green Card eligibility. She can be eligible for an Advance Parole, should she leave the U.S., and also an Employment Authorization.

        I'm not aware of the Dream Act Deferred Action program having any provisions for eventual Permanent Resident status.
