Can my dependent son, who has a valid L2 Visa until 21 Dec, 2014 travel to India before getting the EAD and Advance Parole? We are likely to get our EAD and Advance Parole latest by August 12th, since we applied for I-485 and I-131 on May 12th, 2014 under EB1, even assuming the worst case scenario of maximum 3 months. Since his Advance Parole card will be delivered to my US address, I am hoping to get his Advance Parole card to India for his re-entry.
My son will be 21 years by December 2014 and will lose his status as my dependent child.
Is there any catch in the above plan that would still pose a risk for his re-entry?
