Hi,
I am working in the US on a L1A visa. My wife has recently joined me here on a L2 visa. My company is going to file for my GC in EB1 next month. The I-140 and I-485 documents will be filed concurrently.
I have the following questions:
1> Since we are not sure how long the GC process will take, we would like to apply for the L2 EAD for my wife so she can start working. However, since we are applying for GC next month my wife would have to apply for another EAD along with I-485. I do understand that the two EADs are in different categories but both EADs will be under process together. Will this cause any issues?
2> The I-765 form has a question (Q11) which asks whether the applicant has previously applied for an EAD and the result (granted/denied) of the application. When my wife fills this form for her GC EAD next month, what should be her answer? Her L2 EAD would still be under process so there will be no result yet and we would not know whether it has been granted or denied.
Any help on these questions would be appreciated!
