  • H4 EAD or I485 EAD-Confused due to new Acceptence rule

    Hi,

My priority date is April 2009 and in 2014 when my date current, I filled for my I485 and got my EAD after 3 months.
I got married last month, I was suppose to file my wife H4 EAD and then wait for GC (I485) date to get current to file for my wife adjustment.
But now I bit confused(though i know it great news for me) with new annoucement, you have 2 dates
    1) 2011 for filling and
    2) 2005 for Green card cutoff

My question should I file my wife I485 with AOS based EAD or just I485 and file H4 EAD seprately.
Time is the factor, She will prefer process which is get EAD faster.
    Please help, Thanks

I dont think anyone can say which one (I485 based EAD or H4 EAD) would be faster since no one has yet applied and received EAD under the new rule that begins 10/1/15. As far as I can say, since you have your I-140 approved, you can immediately apply for H4 based EAD. I have seen people getting their EAD in as little as two weeks.
