Me and my Spouse have received EAD which is valid till April 2016. We received this EAD when we applied for permanent residence through the EB1C category concurrent filing. Now my H1B extension is pending and my spouse's I94 has expired in April 2015. I understand my spouse can legally stay in US until 240 days from the date of I94 expiry. My question is , now that my spouse has an EAD valid till April 2016 and because her I 485 is pending can my spouse stay legally in US even after 240 days of I94 expiry? Can she stay legally until a decision is made on the Permanent residence petition?
