  • Renew 10 year old expired ead/Apply for green card

    Hi. This is my first time on this site and I am sooo hoping that someone would be able to point me out in the right direction.

    My brother in law has been in the country for 20+. He moved here in 1990s, met a US citizen and got married. He applied for an received an ead and ss. He also applied for adjustment of status. They had an interview scheduled 2 times, the wife refused to go both times as they were having problems and she was being spiteful. Eventually they separated and finally divorced just recently after 15+ years out of which they were together for about 7-8. My brother in law never received a green card and his ead expired in 2006.

    My question is: Is there anything my brother in law can file to obtain a legal status in the US? He was married for many many years to a us citizen and the marriage was real and he has proof. I was looking into filing i 751 with a waiver but he never received a conditional green card. Is this allowed? Can anyone advise? Also, I am trying to renew his expired ead but since he's no longer married i can not use marriage as a basis for renewing.

    My brother in law hired a couple of lawyers thru out these years but didn't have a good experience. They took his money and didn't do anything so he wants to try to do it ourselves.
    Any advice you could give would be greatly appreciated!
    I have to add that my brother in law is 46 years old and his mother, who is also residing here, is a permanent resident. In fact everyone in the family is a permanent resident except for myself. I am a us citizen but I am his brother's wife so I don't think there is anything i can file on his behalf.
    Is there anything that can be done?

    Your brother should try to self-petition based on emotional abuse by his ex-wife, form I-360.
