  • OPT and f1 status help required

    Hello,
    I want to know whether someone can apply for OPT while his change of immigration status is still pending and is not in f1 status,
    he got graduated and past 60 days of grace period while the case was still pending. is there any other option to apply for opt since he didnt had a choice to apply for it.
    any help is appreciated

    nope he can't do anything related to school, he/she has to wait until whatever immigration benefit he applied for

      thankyou for the quick reply, i want to know whether he could have applied for opt still he was in grace period of 60 days and the case was still pending?

        no he cannot apply for 2 work permit. he should have applied for opt and have the work permit in his hand then apply for adjustment of status.

          he was out of status when he applied for reinstatement and and was his last term of study he got graduated while the case was still pending and got approved in late june,but the got past 60 days of grace period, there should be some chance for him to apply cuz he never had the opportunity to apply.

            u r only given 60 days to apply from the time u graduated or 30 days before...i highly doubt his school's DSO will be willing to submit a request. he already submit the application for adjustment of status why would he want to pay $750 to pay for another work permit that will take the same timeframe to be approve.

            these immigration officers are not stupid! if i was him i will just wait n find something under the table.
