  • Expediting Form I-765 under Severe Financial Loss

    My husband and I are concurrently filing Forms I-130, I-485 and I-765. We will be requesting Form I-765 to be considered for expedited processing under Section 12A as a "severe financial loss to company or person" once we receive a receipt number on the filing. I have been out of work since October 2015, and my husband, the beneficiary, is the sole income-earner in our family. He is currently authorized to work under L1B status. However, his authorization will expire in about 85 days. As I have read that USCIS is taking over 90 days to process work authorization, I will be requesting expedited processing as soon as we get a receipt number.

    I am curious if anyone else has recently requested expedited processing and what that experience was like? Were you successful? And also, if USCIS requested any additional forms and evidence?

    nah dont do it. it will not get approve. ur spouse is suppose to take care of u. u can file it but i doubt it will be approve

      Thanks for the response! Do you happen to know if a denial on the expedited processing will result in a restart or stop in the 90 day regulatory period? If it does restart or stop we probably won't request it then.

        This might result in your application taking longer time. I called USCIS once and asked and this is what they told me.
