Will RFE from i-864 delas the EAD/ Address change

  • Will RFE from i-864 delas the EAD/ Address change

    Hi, All

    I just want to have your personal assessments based on your experiences or best of similar knowledge about my case. Your inputs will be highly appreciated as this will bring me high confidence because waiting without a concrete clue seemed to lower my hopes.


    * July 26 - Packet received by USCIS (PD) - (i-130, i-131,i-765,i-485) stating they will start the process.
    * August 23 - Biometric appointment and completed -
    * August 30 - RFE sent to me in reference to i-485 requesting proof of residence of my wife (petitioner/US Citizen) to my brother who is the co-sponsor (i-864A).
    We were given the option to send the required proof or both sponsors may just send separate i-864.
    * September 12 - We sent back the i-864 of my brother (as the option we choose).
    * September 16 - USCIS received the "response to REF" saying they will continue working on the process again.

    Current Status:
    i-864 - Response to USCIS Request for evidence received.
    i-130 - Case received
    i-131- Case received
    i-765 - Case received

    Am I still inside the ideal processing time or do you have any alarming feedback that may help me prepare?

    **Also, we (my wife and i ) moved to a new address (same city, state). Is this the best time to update the address although the old address still exist and I will still have access getting notifications. Old address was my brother's and we still often drop by the place.

    Just a simple address change should not delay your case but an RFE can. I do not know of all the other forms but for the I-765 I can confirm that the RFE either suspends or resets your clock based on which kind of RFE it was. The case may be same for the other applications too.

      @Raza1- thanks for the inputs. It is highly appreciated. Although the RFE was specific for the i-485 (AOS) mentioned on the RFE mailed to me, would it at any rate have an impact on the i-765 (EAD)?. Afterwards, the receipt notice (specifying i-485) indicates "Our NBC will begin working on your case again".

        If the EAD is based on the I-485 then probably yes. But it appears that your clock was only suspended, so I should not worry too much.

            Hi fensarap, thought I might share my experience so far with you.

            I am applying for I-485, 765, 130 and 131, USCIS receipt date 06/01/2016.

            I got an RFE dated 08/04/2016 asking fro some clarification on income, to which I replied and was received back by the USCIS on 08/26/2016. I also changed my address at the end of July, but I don't think this should affect the processing times.

            On 09/22 I called the USCIS to inquire about my case being delayed (113 outstanding at the time), as the regulatory timeframe is 90 days. I got a response the next morning saying my case is not outside the regulatory timeframe, as the request for initial evidence on my I-485 resets the clock. They stated my case will be processed within 90 days from 08/26 (date of my RFE response). I am going nuts too, as I was originally supposed to start working at the beginning of September, and have been waiting up until now for the EAD approval. I just hope it doesn't take 90 days from the response to the RFE... but unfortunately, the RFE on the I-485 does delay the processing of the EAD. My case has been pending for 129 days as of now, and 43 days since the RFE response.

            Hopefully your case gets processed soon, but unfortunately do keep in mind they are taking quite some time.

              @brazilmania- thank you for the feedback and seemed not impossible we will be sailing on the same boat. The wait is just so frustrating and makes it more painful when we do not have an idea what our papers doing inside their office. For now, hopes for good stories and lucks, and reality for bad testimonies.

              Would you mind sharing what's on the RFE? Because mine did not explicitly says clock will reset.

                Hello guys,

                Just thought of sharing, today Oct13 my status changed to card being produced for the EAD, approved for the AP.

                With all the actual accounts and experiences across, it is still tough to establish a clear answer to our questions on processes. I guess every case is really unique.
