  • F*!# I didn't file i-765 with my 485!!

    HI THERE!

    If i didn't file the Application for the AED with all my 485 package, I already had my biometrics and I already have the status of: "ready to be schedule for an interview"...SHOULD i file the I-765 now? Do I need to send the passport pics again? the birth certificate?
    Have anyone had the same situation before?

    There is no downside to filing now. It's possible at this point that the EAD won't be processed before your AOS is approved, in which case you won't need or get the EAD anymore, but since it's free to apply for anyway, you don't lose anything regardless of whether you get it or not.

    You need to include all the materials that the I-765 instructions say to include, like 2 pictures and a copy of your prior EAD or (if no prior EAD) an ID. You also need to include your I-485 receipt.

      thanks for your reply, it is true what you said, so I will do it. Besides, they are processing May applications, it means It is still a long way to wait.

        Like newacct said, they don't charge to do it, but it's optional too. If you're already in the process to be scheduled for an interview, depending on your situation, if you need it or not, you can wait for your interview when you get your GC. There's people who received their EAD months after they've already been approved for GC. And since you're just mailing yours now and you're in the process of being scheduled for an interview, that may happen.
