  • AED Automatic Extension

Recently USCIS released the guidelines (Fact Sheet) for the automatic Extension of certain EAD. Applicants must have applied before expiration date, have in certain category in valid EAD and this matches with the renewal application.
My question is that according to those guidelines, and the samples in the Fact Sheet, the form I797C (Notice of Action) in which USCIS notifies that case is in process and that fees have been paid, and also includes printed, the category for which your applications of I765 is for. In my case C08 (asylum application pending).
The problem I have is that my employer doesn't want to extend my EAD because the form I797 (Notice of Action) that I received, doesn't have the category / class printed on it. I have everything OK: I applied before expiring date, my category on my current EAD and my application is the same (C08) but the receipt I got from USCIS which is the form I797C (notice of Action), has everything on it but the category.
I have asked everyone I know about this, I even called USCIS NCSC and asked in both English and Spanish, and no one knows if I can get a new copy or if the one I have works.
My last resource is to send a letter to USCIS Texas Service Center, which was the one that received my case, to ask for a new I797C with the category printed on it.

Has any on you had an issue with the extension??? Has anyone had the same issue I have???? I have checked on I797C and all look the same...all my friends, family who have applied for asylum or EAD have the same I797C I have.

My employer says if I don't comply to Fact Sheet Guidelines they will suspend me and terminate me if my EAD expires and I don't receive my renewal on time.

I sent my application with 90 days in advance, I know I should have done it earlier around 120 days, but was so busy at work that days passed and we forgot.

Hove to hear from your experiences!
