I’ve been working on EAD which was coming to expiration. So I applied for a renewal. My renewed EAD card was processed but was lost in transit to my home address by USPS. I’ve now filed for a replacement card but that can take upto 3 months. However my employer has taken my access away and put me on unpaid leave until the new replacement card arrives. As per USCIS website, I can be reverified by the employer and continue work for 90 days using the receipt from i-765 to avoid any gap in employment. However my employer says I can’t. But I m not convinced. What will be the best way to appeal the employer’s decision? Should I seek external legal advise? What is the law for reverification of EAD?
