(Sorry for cross posting).
Dear all,
I have H-1B and my wife has H-4.
My I-140 was approved and my PD is current. I have filed my I-485 application a few days ago.
In the I-485 application, I have filed the I-485 EAD/AP for me and my wife. Thus, on I-765, our eligibility is (c)(9).
After filing this, I came to realize that I may be able to apply a H-4 EAD for my wife. If this is allowed, it would be advantageous to do so because using H-4 EAD is independent of the outcome of the I-485 application and she would not need to worry about losing her H-4 if the I-485 were denied.
My questions are:
(a) Can I submit a standalone H-4 EAD application for my wife right now, while I-485 EAD for her has been filed? Will it affect her I-485 EAD/AP?
(b) Will USCIS issue her two EAD's, one for I-485, the other for H-4?
Many thanks!
