  • New EAD with change of status

    Hello friends,

I'm an F-1 student currently working a full-time job with an EAD under the OPT program, expiring in June 2018. My boyfriend of 5 years (US Citizen) and I are planning to get married soon. If I were to apply for the green card/new EAD with a change of status, will my employment be interrupted? As in, will my current EAD (OPT-F1) be voided and I have to quit my job and wait for the new EAD and continue working? Or can I still work with the current EAD, and if the new EAD arrived before the old EAD expires, my employment won't get interrupted.

I know it's a long question but I really needed your help. Thank you!

I was an international student and I worked with an EAD under Post-OPT program and I also applied H1b visa, but I did not select.
At that time, I already applied to green card because we were planning to get married soon.
I heard from our company's lawyer that I could work until I got H1b visa rejection letter.
Finally, I got the letter and I stopped working. I think you can work with current EAD card.

You can continue working using your current EAD card. Once you apply for AOS/I485 (GC), you can apply for an EAD along with it, for free. Upon receipt of that EAD you can switch to it or continue working with your current EAD, if it did not expire. If you travel outside the US prior to receipt of your GC, and have applied for AP (free with I485), then upon re-entry to the US, you will no longer be on F1, and will have to switch to the EAD that came with your I485 application.
Just an opinion; Not legal advice.
