  • Applying H4-EAD without attaching H1B approval notice

    Hi All,

I need your suggestions for a query w.r.t. H4 EAD application submission.
My H4 extension has been approved on 29-Aug-2017 and I received the approval notice on 02-Sep-2017. My husband's H1B approval came after my H4 was approved. He got his case approved as per the USCIS case status checker on 08-Sep-2017. We are still waiting for his approval notice to be emailed to us from his attorney.

I would like to apply for H4 EAD asap. We have the i140 approval and all other documents in place.
    I have 3 questions.

Question 1: Can I proceed with the submission of my H4 EAD application (form I-765), without attaching my husband's (H1B principal beneficiary's) approval notice for H1B extension (form I-797 approval notice for I-129)?
(Or) Should I wait till we receive his approval notice for H1B extension and then submit my EAD application along with that?
The USCIS site's relevant page for H4-EAD, does not specify anywhere regarding the requirement of H1B Principal's approval notice (form I-797 approval notice for I-129) for applying H4 EAD. They are only asking for the receipt number of I-129 petition be quoted in the H4 EAD application. But I am confused as to whether my husband's H1B approval notice is needed or not. Please advise.

Question 2: As I am in H4, I dont have an SSN. I have only ITIN. So, in the H4 EAD application form (form I-765) for the column Social Security Number, should I respond as N/A (or) should I give my ITIN number?

Question 3: How long is the processing time for H4 EAD ?

    Thanks in Advance,
    Geetha12.
