  • EAD Card lost. Can I expedite?

    Hi, Ive been waiting 175 days for my initial EAD card. It was allegedly delivered to me on Aug 1 but I did not receive it.
    Now Im being told that I have to reapply. That could mean waiting another 130 days.

    I cannot afford to be without work for 9 months. I do not have the finances.
    I know that one of the expedite criteria is:

    Severe financial loss to company or ​person​;​
    Emergency situation;​


    But these are for the first time you apply. They lost my card (although will not admit it) and so now Im having to apply again.
    Surely it is unreasonable for them to expect me to live without work for 9 months?

    Is there a way I can get this expedited?

    Take your passport and both I-765 approval notices to an Infopass appointment at the field office and try to negotiate for a I-766 stamp to be placed in your passport

      Thanks, but hasn't that been stopped now? Also I only have one I-765 approval notice, as so far theyve only lost ONE card. I am now applying once again. So in 90+ days I will get my second I-765 approval notice. Im simply saying Ive already been 6 months without work. I cant afford to be another 3-4 more months etc.

        They stopped giving I-766 stamps to people who waited longer than 90 days, but your situation certainly warrants sympathy and may warrant some relief

        As you say, you aren't working and you really want to work, so why not spend a day sitting in a Field Office pleading your case to every immigration officer you come across?

          Oh wow, so they still are able to give I-766 stamps then? Didnt know that.
          Also can I just turn up and get an Infopass apt? I live in NY and its almost impossible to get an apt via online. But when I went there it was dead quiet.
          So can I just "show up" and like you say, try everyone in that office? Do they all have the authority to give I-766 stamps?

            I believe a receipt for a lost card replacement can be used to work for 90 days.

            This is my personal opinion and is not to be construed as legal advice.

              Really? I didnt know that was possible anymore. Does anyone else know about this?

                  Awesome, thanks Inadmissable. And does this still apply? I assume this would help me find employment. But would I need a social security number first? Obviously I dont have one because I never received my EAD. Do you think I could take my receipt for the replacement card, along with a copy of my I-765 approval notice and my Receipt Notice for my I-485 to the social security office and they might provide me with one, or am I still SOOL?
