  • Should I dare to travel or not?

    Hi everyone!

To make the long story short - More than 2 months ago i received my work permit and advance parole. I haven't seen my family in years and I'm desperate to visit them in Serbia for at least 10 days. I was planning to wait for a green card, but the process has been longer than i expected.

Please, what is your opinion and experience with traveling with advance parole?

My biggest fear is that I wont be admitted to USA and that I won't be able to see my husband again...

Any help is welcome. thank you

The whole point of Advance Parole is to allow you to travel.

This is my personal opinion and is not to be construed as legal advice.

      Advanced Parole

My lawyer told us we can travel as soon as we get the advance parole documents. She said if there is prior criminal history we may have a problem but otherwise that is what the document is for - to travel before the green card is approved
      11/20/17 - PD - Marriage Based AOS
      12/10/17 - Walk in Biometrics
      4/10/18 - EAD & AP Approved
4/18/18 - Interview ready to be scheduled
4/19/18 - Combo Card in hand
10/22/18 - Interview has been scheduled
      11/26/18 - Interview Completed
      12/6/18 - GC in hand

I have the same worries, because my husband came in on the VWP ESTA program and it's obviously past that stamp's expiration.

Guess the best thing for both of us would be to ask our lawyers!

The case law in this area says otherwise https://www.justice.gov/sites/defaul...28final%29.pdf

I think posts advising caution, while well meaning, verge on the borders of fear mongering. The whole point of AP is to allow you to travel while awaiting the decision on your AOS petition. From personal and other experiences, travel with AP is perfectly fine. Just be prepared for a slightly longer wait at immigration so that they can check your AP status during secondary screening. Other than that, it is just like an entry with a valid visa. Will there be some refusals to admit? Yes, but the risk is no more than what you will have even when you have a valid visa. Entry into the US is guaranteed only for citizens. Everyone else has a finite, albeit infinitesimal, probability of refusal to admit.
Just an opinion; Not legal advice.
