  • From l1 to ead marriage based

    Hello all,

I came into the country 3 years ago with an L1 visa, I got married with a US citizen 1 year ago and me and my husband decided to apply for my adjustment of status through our marriage, we filed all the documents on December 2017, our PD: is December 5 2017. I already did my Fingerprints on January 5 2018. Currently I'm still under my L1 Visa until February 22 2018 and I'm still working for the company that Transferred me 3 years ago, the question is:

Clearly with all the immigration department delays i will not received my EAD by the time my L1 visa is due, so what should I do, I 'm still able to keep working for the company, or they have to cancel my contract until I get my new EAD?

My lawyer say I'm good, that they will not be any problem cause I'm already under a process, and the date that matters is the 5 of December. What do you guys think?

If someone had been through this please let me know,

    Thank you!!!!

Your visa expires then? or your status? Visa and status are two different things. Visa expiration has nothing to do with how long your status lasts.

If your company is doing things correctly, they will not let you work if you are out of L1 status with no extension pending, before you get your EAD. If your company applied for an extension of your L1 status, then you can work while that is pending.

"not any problem" for what? For staying here, yes, you can stay. For working, no, you cannot work.

This is my personal opinion and is not to be construed as legal advice.
