  • International travel while GC still pending with Advance Parole

My husband and I would like to travel to Jamaica to visit his family in August. We are october 2017 filers. We have not had our interview for the GC yet. Do you think there will be a problem for my husband to re-enter the US if he doesn't have his GC by August just using the EAD/AP?

if you have not been approved for advanced parole(AP), and you leave the country you are considered to be forfeiting your AOS application. it would be recommended that he wait until he has been approved for advance parole before he travels and if it is an emergency then he can request for his advanced parole application request to be expedited due to an emergent nature. over all though if he does not have AP it is recommended that he does not travel.

Thank you. He does have approved AP with an expiration date of January 2019. So, he should be ok to travel in August I'm assuming. Hopefully we will have our interview and his GC by then,

My apologies, I missed the section of your OP where you mentioned that he already had advanced parole, you are fine to travel. have a safe and enjoyable trip. I'm sure the weather is 10x better there than it is anywhere in the US right now
