  • Is it safe?

Hi guys! I?m currently waiting for my EAD/AP combo card, and my question is once I get my SSN and license, will it be safe to travel locally like from Coast to coast? I really want to visit NY and I live in SanFrancisco.

Thank you so much. Best wishes to everyone.

You don't need AP or EAD or SSN to travel across the country. You only need a drivers license if you plan to drive.

I?m scared to board any planes since I?ve overstayed my visa a couple years now, and the CA ID I have here has ?federal limits apply?. Will my foreign passport be alright for local travels? My current passport doesnt have my expired i94 on it though.

It is safe for you to travel - carry a copy of your I-485 filing receipt (the letter titled "notice of action") with you

There are no immigration checks when flying within the United States - even between the continent and Hawaii/Alaska

However, you should present TSA officers with your unexpired foreign passport, rather than your AB60 drivers license. Don't carry cannabis through the airport

By the way, all non-REAL-ID California driver's licenses issued since January 22, 2018 say "federal limits apply" on them, not just AB60 driver's licenses. Anyone (including citizens) who renewed a pre-2018 California driver's license without going in person to the DMV to apply for a REAL ID driver's license will get a non-REAL-ID driver's license that says "federal limits apply" on it. Non-REAL-ID driver's licenses can be used to board any US flights before October 2020.

This is my personal opinion and is not to be construed as legal advice.

I realize theres recent changes but the restrictions dont apply until 2020. Youre fine. I recently learnt theres some risk traveling to PR and VI because you do go through customs but I personally never had an issue traveling using just ID.

My concern is that I don?t have the real ID/License yet for I?m still waiting for my ead/ap combo card.
I do have a foreign passport that doesnt have my expired visa on it. So I wonder if thats going to be fine?
I?ll be coming from SFO and I want to go to JFK.

Either your foreign passport or your driver's license (even if it says "federal limits apply" on it) should be fine for passing through TSA security at an airport prior to October 2020.

In any case you have your I-485 receipt so you have nothing to worry about even in the unlikely chance you get checked by CBP.
