EAP which reasons are really valid?

  • EAP which reasons are really valid?

    Please can someone help or tell me their experience?

    If someone married within the US, applied for AOS, but needs to leave within the first weeks afterwards for work, as there is still an overseas work contract, otherwise that person would break the contract and lose the income, plus break the contract, would that be a reason for EAP?
    (on the other hand, the US citizen spouse has to proof to earn enough for both... but breaking a work contract and deserting the company, is that expected?)

    If someone has a tumor and wants to have it removed in their home country, as it is cheaper and they dont trust it more and want to be surrounded by immediate family, is that an acceptable reason for them?
    Or do they state that docs in the US are good enough and the US citizen spouse should be able to get health insurance for both and cover all?

    I don't think those reasons are urgent enough for an Emergency AP.

      Are you looking to expedite your AP? Or are you referring to Emergency AP?

      You can request to have your AP expedited for a number of reasons. As I tell everyone, "let THEM say no". Financial hardship to a company caused by your inability to travel, would be a reason to raise a request to expedite it. If they decline it, then you run to your Senator, list all your credentials and pedigree, and USCIS gets a wrist slap - EAD/AP approved.

      Emergency AP is different. You would make an InfoPass appointment at your Field Office, and present documents to support your need for emergency AP. Be prepared to pay for the $575 fee. You'll probably be there all day. They may give you the option to have your AP expedited which would take a few days, OR pay the $575, and have the Director of the Field office give the green light on Emergency AP. Either way, you must have biometrics done first - so there's that.
