  • Waiting on new i-131 (combo card) trying to travel abroad for wedding...

    Hello!

    Does anyone out there know, if I were to leave the US with my current AP (i-131), it expires while I'm out of the country, and I return to the US with my new card (which somebody will bring to me abroad) will this fly? Will my i-131 application be trashed as well as my green card application?

    No. You must leave after an AP is granted, and re-enter on that same AP. Even if you get a new AP, you cannot use the new AP to re-enter on this trip, because you left before that new AP was granted; though you will be able to use that AP on future trips. (However, they are currently denying APs of people who leave the country while the AP application is pending, so you will almost certainly not get a new AP while you are away.)

    Alternately, if you have H1b/H4/L1/L2/K3/K4/V status when you leave the US, you can return on the same type of visa.

    Otherwise, if you leave and don't meet either of the above conditions, your AOS will be abandoned.

      Has your new combo card been approved and you're waiting for it to arrive? or are you waiting for approval for the combo AP and EAD card?

          ok so yes as NEWACCT said, you can travel on your current AP but won't be able to return on the new AP, and if you leave before it's approved it will be considered abandonment of your I-485. it is recommended that you wait to travel unless you already have an H1b again as NEWACCT said.
