  • I-765

I have posted on here several times, as I have spent thousands on an attorney who in fairness did submit my I-130 and 1-485 and I-765. I cannot get clarification from them, but I had no idea that on receiving you I-765 you still cannot travel. Is there anyone out there that confirm one way or another. 20K later with attorneys and I can never get an answer.

The I-765 is the Application for Employment Authorization (Employment Authorization Document i.e. EAD) which allows you to work in the US.

The I-131 is the Application for Travel Document (Advance Parole) which allows you to travel while you have a pending I-485.

When you apply, if you send in both of those forms with your I-485, you usually end up getting a combo card, which shows you're able to work in the US as well as showing you're able to travel out of the country without abandoning your I-485 application. If when you sent in your forms you only sent the I-765, then you won't receive a combo card and just the EAD.

If this is the case, you'd now need to file a separate I-131 for advance parole, which will probably take a while, the NBC is showing a 4-6 months processing time at the moment. You can enclose a copy of your I-485 receipt with this application so that the fee gets waived for filing it on its own.
