Traveling without Advance Parole but with L1-A Visa

  • Traveling without Advance Parole but with L1-A Visa

    Hi,

    I would like some views on the risks associated from traveling with my L1-A Visa (valid until Oct-19) whilst my Advance Parole is being processed (AOS submitted Jun-18 and according to my lawyers will take 6 months for AP card to arrive). I'm from the UK and will be traveling back to the UK for 3 weeks.

    From what I see on this site (and a number of other sites including CBP) it will be OK to travel using the L1-A Visa. It seems there may now (due to recent policy changes?) be a chance that my AP will be denied. If this is the case, then does it mean I will just need to get it resubmitted or will it be denied for the duration of application? Also, what is the likelihood of this causing my entire application to be cancelled?

    As for experience, i travelled while waiting for AP/EAD on valid L1-B visa.
    I got back 2 days before it was about to expire.
    Immigration told me it was going to expire in 2 days, i told him i was waiting on EAD/AP.
    He said, i dont care, i'm just letting you know your visa is expirng and then he gave me a stamp to enter.

      You can travel on L-1. It will not cause your I-485 to be abandoned; this is specifically stated in regulation. It will likely cause your pending AP to be denied under current policy; you just have to apply for AP again when you get back; it's free anyway.

        Thanks for the responses. Do you know the timeframe for receiving the denial, assuming the application was submitted end of June and I travel mid August?

          There's no guaranteed denial, i was able to travel on L1B and got my AP anyway.

            Just heard back from my attorney. Response was that it's fine to travel with L1-A, however the AP might get denied. If that happens then they would simply apply again. No additional cost except for their legal fees, which my work will cover anyway.

            I really just wish they had told me this in the first place rather than telling me not to travel at all.
