  • AP travel, any resent experience?

    I booked a resort in Mexico for us in late October for a week and now pretty worried if this is safe to go with the AP due to the political situation in emigration? I know no one could say exactly, but may be any of you had resent experience? Attorney I contacted said it up to you. This is not an emergency and sure I can cancel the trip. We just so want to go and have some rest. Tourist visa and marriage. Visa wasn't overstayed. AOS pending.
    I?ll be very appreciated for any thoughts and advise.

    April 27 - Check cashed - PD
    April 30 - Received 4 emails from USCIS with receipt numbers
    May 5 - Received 4 NOA-1
    May 11 - Biometrics scheduled for 5/23/18
    May 23 - Biometrics completed
    May 23 - Courtesy Letter Biometrics
    July 20 - USCIS Rep level 1 said background check completed

    I'm in the same situation as you. Tourist visa, got married, didn't overstay. AOS still pending.
    Do you have an EAD card with i-512 designation on bottom right of card ("serves as i-512 advance parole") that is valid past October?

    I just got back from the UK this week, after a short 5-day trip. CBP officer had no issue with my EAD card (valid til end of the year). My lawyer gave me the same warning that re-entry was not guaranteed and that there was a risk. It wasn't an emergency but I wanted to go.

    Some advice:
    - bring i-131 approval letter with you (the original) along with your EAD card and passport

    - give yourself extra time checking in for return flight. Airline was checking if I had an ESTA, I told them I had none and showed EAD. She didn't know what this was and had to check with supervisor. Took about 20 mins as they made phonecalls but they got it sorted (probably entered me as AP)

    - you cannot use an ESTA (if you have one), you are not a tourist. There were 3 lines at immigration:
    1. Returning US citizens
    2. people who have ESTA and have been in the US in the past 6 years
    3. people who are using ESTA for first time (or have a different visa).
    You need to go in line 3. You don't have either an ESTA or a visa ("you're in limbo" as the CBP officer said to me)

    - hand over EAD card and i-131 letter first, then your passport. It's the EAD card no. that the officer will use to enter you in the system, not the passport no. I handed over passport first and the lady got confused wondering why I had no ESTA

    - here's what took the longest time: the CBP officer knew what AP was and i-512 but did not know how to enter me into the system for re-entry, as I was her first APer (she was looking for AP and i-512 but there's no option for it - maybe the card is a new thing?). She called over supervisor and even he wasn't sure. They were both incredibly friendly and didn't ask a single question about my status or where I'd been. In the end they put me as "returning resident"

    I hope this helps. I think you'll be fine as long as you have all the above docs.
    I may have just gotten very friendly CBP officers but I can't see even the toughest officer arguing with a government-issued ID and no violations.
