  • EAD Expiring on Dec 4. Advice needed!

    Hello,

    I'm sure there is more than one person here who has had this issue.

    My husband's EAD is expiring on Dec 4th of this year. His employer has sent him an email notifying him that he cannot work beyond that date without a renewal.

    I've read on the website that he will receive an automatic 180 day extension since we are still in AOS process (I-485). Our PD date was 9/5/2017 and we still haven't received notification of an interview.

    I'm not sure how to approach this. Do I simply let the employer know this information or do I need to submit for renewal right now? I would really like to avoid paying the I-765 fee again if possible.

    Advice is appreciated!!!

    You can apply 180 days before the expiration of the EAD. No fees are required, simply send in a copy of your pending i485 notice of action i797.

    Once you are eligible for the extension , the new NOA you receive will have a note about the extension . Show that to the employer once received.

        keep in mind that you must apply to get the extension, otherwise it just expires!

            Once you apply for renewal, your NOA comes with the automatic 6 month renewal. So, apply well in advance for renewal (in other words apply asap). Since you will get the automatic 6 month renewal the actual date when you get the renewed EAD becomes immaterial since your ability to work is not hindered for 6 months after the original expiry date.

              Thank you so much! I was kind of freaking out for a second there.

              Reading the instructions for renewal it seems I only need to submit the following. Does this sound correct?

              - Signed renewal application
              - As a c9 application, no I-94 or passport copies are required?
              - Photocopies of both the front and back of current unexpired EAD card
              - 2 approved identical passport photos
              - No fee

              It doesn't say anything about sending a copy of the I-797 for I-485. Should I go ahead and send this anyway?
