  • Expedite Process - Questions

    Hi all,

    I noticed that there is not much information on the expedite process outside of the criteria.

    Married to USC (C09)
    My PD is April 05, 2018 (I-485,I-130,I-765,I-131)
    NOA1 is April 12, 2018
    Biometrics done - May 04, 2018
    I-485 - Case is Ready to be scheduled for an interview July 17, 2018

    No updates on EAD/AP.

    Previous EAD (OPT STEM) expired on 08/02, stopped working on 08/01. Job is safe for now.

    My question is:
    1) Does expediting remove your place in the queue?
    2) Does it take months to approve the expedite request?

    I have been told by lawyers that the following above is true. What has been your experience?

    3) At this point, based on my timeline, should I expedite? I am burning through savings and have a small family. I can show financial loss and also work for a non-profit which heavily contributes to the US as a whole.
    4) It seems that if one calls, one has to wait for USCIS to request evidence. Do lawyers or senators send evidence with the expedite request?

    Any thoughts? Thank you in advance. I am hoping some of my questions could help others who qualify under the expedite criteria as well.

    I would call if I was you. I requested an expedited EAD two weeks ago, they requested proof in a job offer letter, I submitted it last week and heard from. Them today that they received my info and will send me a response shortly. I called this morning before I had received the email and the person I spoke to was extremely helpful.
    Marriage based Greencard - Concurrent filing
    06/11/2018 - Sent forms via USPS Expedited
    06/14/2018 - Priority Date
    06/21/2018 - USCIS cashed check
    06/25/2018 - USCIS 4 NoAs received by mail
    07/07/2018 - Received Biometrics appointment for 07/20/2018
    07/09/2018 - Biometrics done on a walk-in
    07/19/2018 - REF requesting I-864 received
    07/26/2018 - I-864 mailed
    07/30/2018 - USPS confirmation I-864 received

      I am with B2 visa who filed I-485 marriage based concurrent filing with I-130, I-131 and I-765. PD is July 11, 2018.

      I would like to know if there's a way that I can request to expedite my EAD? I really want to look for a job now. Any info would be highly appreciated.
      Adjusting from B2 visa

      07/09/2018 Sent AOS Package
      07/11/2018 Priority Date
      07/30/2018 Biometrics Done
      08/08/2018 Case status updated to "Interview Ready to be Scheduled"

        expedite process experience

        Hi, in my experience it is worth a try to request the expedited process. My PD is 05-07 I called USCIS and initiate a expedite document request on 09-04 based on financial hardship since I have been able to work for the past 6 months and a current job offer that would improve my situation, I had to spoke to 2 different people before they take my request and the answer or request for further evidence would be no less than fifteen days. In my case the next day my status was updated to card being produced and now it is being mailed. My lawyer said it wouldn't make a difference and that usually this request are denied but again my experience proved otherwise, good luck!

          1. Expediting will not affect your place in the queue. To be clear, it does not reset your priority date.

          2. I would say that it can take anywhere from a few days to a month. It depends upon how many expedite requests they have. People aren?t expediting as often anymore.

          3. Financial loss works - whether personal or to the organization. To everyone reading this, do not wait until you have to stop working. It?s easier to expedite before you lose you job. If you absolutely have to stop working, just request an unpaid leave of absence.
          I would request a letter from your employer stating that you may return to work as soon as you are able to provide proof of employment authorization. If they?re cool with you, they could also throw in some words like ?your absence translates into financial loss to the organization? etc.

          4. You would call to request to expedite. Insist that they enter a request for your EAD & AP. That way you?ll get a combo card. We?ve seen USCIS only approve the EAD if folks don?t enter a request to expedite the AP as well. No worries. You will only need to furnish evidence for the EAD.
          Then as soon as you submit it, you can reach out to your senator. They?ll want to see the evidence you sent etc.
