I currently have 2 applications going on with USCIS - H1b filed by my employer (Case selected for consideration but not approved yet - RFE received 8/23/2018) and also I-485 AoS (filed June 26, 2018).
My F1 OPT expired in July but because my h1b case was selected, I have a cap-gap extension till 9/30/2018 before USCIS make a decision on the case. Unfortunately I have received an RFE on 8/23 and it is looking like my case will take much longer before USCIS make a decision on it, and I have heard nothing about my EAD card from AoS case yet. I will have to force to stop working if I did not received my EAD card or h1b approval by 9/30/2018.
My question is, should I expedite my EAD card? I don't know if they will need me to provide any proof for financial loss but I really want to secure my job with my employer. They told me if they terminate me on 9/30, there is no guarantee rehire. I am stress out of my mind.
Any advices would be greatly appreciated! Thanks!
