  • Traveling after Unlawful Precense with Advanced Parole

    Can someone give some input about traveling with AP after being under "Unlawful Presence"? I overstated for 6 months before applying to I-485. I've read some mix opinions about it and im afraid i would have any problem returning back after a quick(1 week) emergency trip.

    Any suggestion /opinion would be nice! Thanks

    There's no reason to believe that the amount of unlawful presence you may have has anything to do with whether the officer will parole you or not.

    This is my personal opinion and is not to be construed as legal advice.

        My husband overstayed by 2 months before we applied for AOS. We just returned from a trip to Jamaica. He had no problems. When we arrived back in the US, the officer took his picture and finger prints, then we were sent to another room where another officer looked up something in the computer and stamped his passport. It took about 5 minutes.

            My husband overstayed 4 years and we just got back from our second trip since getting AP - no problems
            11/20/17 - PD - Marriage Based AOS
            12/10/17 - Walk in Biometrics
            4/10/18 - EAD & AP Approved
            4/18/18 - Interview ready to be scheduled
            4/19/18 - Combo Card in hand
            10/22/18 - Interview has been scheduled
            11/26/18 - Interview Completed

                    So they dont need to check for the visa?
                    They just want to check your passport and parole?
                    Coz I?ve been out of status for a few years, and would really like
                    to visit my homecountry. Though my lawyer reassured me everything is gona be alright since I have not committed any crimes.

                      No, they didn?t check the visa. I just took it to make sure.
                      The weird thing is about the automated machine. There was no option to put your parole. I had to fill as B2

                        I read a couple of comments from a thread, that parolee should skip the machines and head straight to an officer?
                        Im not sure how it works nowadays coz its been years since my last international trip.

                          Travel to Canada using AP combo card with approved Canadian eTA

                          Hi everyone,
                          Has anybody gotten a Canadian eTA (electronic travel authorization) using their USCIS number in the AP combo card? I was granted a Canada eTA using my USCIS number in the AP/EAD combo card.
                          Please share your experience crossing into Canada with eTA and your USCIS AP/EAD combo card.
                          I am planning a brief 10-day trip back to my home country via a Canadian airport on account of flights having faster travel times (12 hours shorter roundtrip), on return I will cross the Canadian border into the US.
                          Will gratefully appreciate it.

                            eTA is only for nationals of certain countries who are visa-exempt to arrive in Canada by air, as well as US permanent residents to arrive in Canada by air. You are not yet a US permanent resident. And for nationals of countries which are visa-exempt to arrive in Canada by air, I don't think the eTA application asks for any "USCIS number". So I think you must filled out the application wrong.

                              I was hoping to get a reply from those who actually made a trip identical to my travel plan and I appreciate your effort.
                              And for the benefit of those who may be interested to do the same, the 9-digit USCIS number in the EAD/AP combo card was accepted in the eTA online application, so my passport number is now linked to an eTA (I also printed the eTA approval email).
                              For other references I found this in the eTA website "The ETA Expansion Eligibility" Subsections R7.01(1) and (2) expand the eligibility criteria of the eTA requirement to allow certain foreign nationals who meet specific conditions to apply for an eTA. These foreign nationals may apply for an eTA only if they are travelling to Canada by air and if, at the time of application, either of the following applies: they have held a Canadian temporary resident visa (TRV) in the past 10 years OR they hold a valid U.S. nonimmigrant visa (NIV). If such an individual does not meet the eligibility requirements listed above and is not a U.S. lawful permanent resident (that is, a green card holder) they are not eligible to apply for an eTA. They must then be in possession of a valid TRV to travel to or transit through Canada. If a foreign national holding an eTA on the basis of eTA expansion eligibility is travelling to or transiting through Canada by a means other than air, they must have a valid TRV".
                              I am fortunately still a holder of a valid US NIV, so as you can see I am trying to get validation for my understanding of this rule.
                              And this is also why I am flying out of the US into Canada and will take a border crossing by land back into the US.
