  • Applying for EAD while waiting for marriage interview results?

    Hello all,

When I initially applied for adjustment of status to permanent resident based on marriage, I did not apply for an EAD because I was already on my STEM OPT and had a valid EAD until end of Feb 2019.

We had our marriage interview yesterday which went quite smoothly I think (we didn't get separated and the officer said there won't be a second interview). However, he did say that the interview results will take about 120 days to come in.

Because of this, I want to apply for an EAD now so that my current one doesn't expire before I get my results (especially if there are any complications).

Since the officer at my field centre (Baltimore) already has all my other submitted documents, where do I file this application for EAD? Will this cause any additional delays/complications to my adjustment of status? Anything else I need to be aware of? Thank you!

You file EAD and/or AP applications based on a pending I-485 to the Chicago Lockbox, as described here. Note that it may take 5-6 months to get the EAD.

This is my personal opinion and is not to be construed as legal advice.
