I need some advice as to how to proceed with my wife's change of status case. She is employed with an H4+EAD and her employer is suggesting to apply for H1B considering the upcoming legislation. She had H1B prior to the H4 and has used 4 years out of the 6 years quota.
My understating is that as soon as she changes the status to H1B, she will have to go for GC filing. Would 2 years be enough time to get the I-140 approved so that she gets the further H1B renewal? Or considering the current situation and since the ruling is not yet announced, it is better to wait for the EAD announcement.
