  • Important Travel abroad BUT my AP is pending...

    I have few questions about my Advance Parole and the important travel (for a wedding) that we need to make to India coming November. I saw some great replies for questions in this forum and I would really appreciate if you can help me here..

    - Both my wife and I need to make an important trip to India coming November and our Advance Parole applications are still pending (applied on June 15th of 2006). We both have our own H1B's but haven't got the H1 visas stamped yet on our passports. So, we are eagerly waiting for this Advance Parole to go through so we can make this important trip to India and reenter US without any problems. My question is, what if our AP application gets delayed and if we don't get our AP before our travel date?. Is there a way, we could appear at the local USCIS office and get our AP's if we don't get it within 90 days? If yes, do you know what are the procedures and ways to get that done?

    - As a backup (while our AP applications are pending), can I go ahead and make an appointment at US consulate in Canada for our H1 stamping? Can we travel outside US (to Canada in this case) while AP application is pending? I heard that you can't travel outside US while the AP application is pending or else I will abandon my I-485 application?

    - Do we need to have our fingerprinting done to get our AP? The reason, I'm asking this is we went for our fingerprinting appointment yesterday and noticed that my wife's name is misspelt on her Biometrics receipt notice. Inspite of that they took the fingerprints for my wife, and told that they couldn't correct that typo as it is entered wrong in the system and I have to contact USCIS service center to get this corrected on their system. This fingerprinting is for our 485 application, and I'm not sure whether this will affect our AP processing in anyways? My attorneys are going to followup with USCIS by sending them a letter to correct the typo in my wife's name. But, is there an easy way to get this name typo corrected (by just calling and speaking with a person at USCIS)?

    I would really appreciate if you can help me here and advice on what we should do to make our travel to India coming November. Thanks a bunch in advance.

    I think you can correct the misspelling ove rthe phone.....if not, your lawyer should write and have it corrected and anyhting is writing is always better........the information supplied over the phone is only as good as the person receiving and entering it in the system

    No separate fingerprinting is required for AP

    Its unlikley that you would not have the AP prior to your travel

      Excellent, curiousone. I have been seeing your replies in this forum and you have been of a tremendous help and you seem to have so much of knowledge in this Immigration system. Thanks and I have few more questions...

      1) Will the spelling mistake on the name in the Biometrics receipt notice, affect the processing time of my Advance Parole in anyways? The names are spelt correctly on the Advance Parole and EAD receipt notices though.

      2) Will the fingerprinting (biometrics) we took for the I-485, be used for our EAD or AP cards? I'm asking this because, the spelling mistake on our name has happened on biometrics record and I don't want any confusion/delay to happen when they try to pull out our fingerprinting record while issuing our AP/EAD (which has correct spelling on the receipts).

      3) Can I go for my H1 visa stamping at Vancouver, Canada while my AP application is pending?

      4) Incase I don't receive my AP's within 90 days, can I appear in the local USCIS office in person and get the AP's?

      I really want to make this trip to India this time, and I just wanted to have all my papers right before I make this trip.

        1. I shouldnt think so.............but you need to correct it. I know youre convinced now though that it does affect it since the EAD ha sbeen approved but not the AP...........all you can do is write to correct it and wait....

        2. I meant to ask prior then noticed your other post...........are you sure it wasnt for the EAD?.........to b efrank, I'm still not sure if two diff sets of fingerprinting are done for the EAD and I-485 but fingerprinting is required for both so I guess if you went for I-485 and your EAD has been apporved it worked for both. Non e is required for AP

        3. yes, you can .....but what if its refused?...how would u get back in?........i dont kno wmuch about H-1 s so hopefully someone else can help u wiht that
