    Hello,

    I am a Canadian working in USA on a TNVisa that expires beginning of Oct. I married a US Citizen in March, and filed my I-130, I-485 and I-765 on July 10, and received receipt numbers for all the forms.

    Over the weekend, I recieved a Request for Initial Evidence (I-485) letter from USCIS saying I need to submit a I-693 + supplemental form for a medical exam and documentation of immunization.

    The part that has me very worried is the letter states : "You are ineligible for interm employment authorization pursuant to Title 8, Code of federal regulations, section 103.2(b)(10)(ii) until 90 days after the missing initil evidence is received"

    The letter is for my I-485, so I am not sure how it effects my I-765. Does that mean that my EAD will not be approved until 90 days after my exam results?? Or is it just my ability to request an interm EAD that is effected? I was waiting eagerly for my EAD approval to arrive inthe mail any day now!! If my EAD is on hold... That is very bad for me because my existing TN Visa runs out Oct 2!

    I have not received any documentation on the status of my EAD, and if I check the receipt number online, it is not recognized!

    Not being able to work for 2+ months will have a dramatic impact on my life. Will I need to leave the US when my TN runs out then?? Aaaaargh!

    same thing here dear, i got a mail from uscis asking for more evidence last july 28 and then i send them what they need august 5, same mail we got. And my problem before is i cant check my status online so now i am approved for my ead but waiting for the card, thats the email they sent me , wait for the card that they are going to mail me, dont worry it come, i wish this would help you, i just dont want you to worry that much, because i do too before and now im ok, it makes me so depressed before but i am ok now,

      If I were you try to visit http://www.immihelp.com/timings/tracking.jsp and register that way you can be notified thru your email by uscis that comes automatic whenever there is an update in your case. We have a similar case, uscis requested for an additional evidence from me which is the medical examination that bothered me at first when I got the notice coz I thought it might take longer for my EAD to come out. I received the RFA back in July 28, 2006 and completed it in aug 29, 2006. USCIS received the additional evidence in September 5. On September 25 my EAD was approved and received the card on September 28, 2006. If you read the notice it says something about the processing time will be shorter since preliminary processing has been done. One more thing, in my conversation with one of the uscis agents, you really have the option to send your medical examination together with your I-485 application. But they don't encourage it because the processing time for a case might take longer than a year which makes the medical examination useless. Hope this helps.

        even they send you aletter for request initial evidence you EAD is still process?
