I hold a valid H1B visa till mid next year. My passport is stamped, and I have the original I-797C.
My Adjustment of Status application is pending. I did apply for EAD and AP but never used it. In all my paper work I have always declared my status as H1B even with USCIS. My AP is now expried. I need to travel urgently, and I don't have a new valid AP.
During my AOS interview, the officer took away my I-94. So I don't have any
I-94 to surrender when I leave US.
So If I leave US, and reenter on H1B, will not having surrendered my I-94 cause any trouble? Will I be allowed to reenter?
(I plan to have my H1B, and receipt of I-485 with me when I reenter)
